New Jersey Solid Waste Checklists
Solid Waste Transporter - Truck @ Facility Requirements (SW20) - Short Version

SOLID WASTE TRANSPORTER - GENERAL REQUIREMENTS.  
Did transporter register any device used for the transportation of solid waste as either a solid waste cab, trailer, container, or single-unit vehicle?. [N.J.A.C. 7:26-3.2(a)2]  
Did registrant ensure registered vehicles, cabs, containers, etc., are not used, controlled or possessed by any other person?. [N.J.A.C. 7:26-3.2(a)4]  
Did transporter not alter N.J.D.E.P. solid waste transporter registration certificates and decals?   Note: Departmental representatives shall confiscate altered or stolen solid waste transporter registration certificates and decals upon discovery. [N.J.A.C. 7:26-3.2(c)1]  
Did registrant submit to the Department by May 1 of each registration period, a registration statement updating the information contained in the previous registration statement?. [N.J.A.C. 7:26-3.2(d)]  
Did the registrant notify the Department in writing within 30 days of any change in the information supplied on its current registration statement, or on any leases submitted for registered solid waste vehicles, or on any documentation of leased operators of equipment submitted pursuant to N.J.A.C. 7:26-3.2(j)?. [N.J.A.C. 7:26-3.2(e)]  
Did operator not engage in or continue to engage in the transportation of solid waste during the period when a solid waste decal and registration certificate were withheld pursuant to this subsection?. [N.J.A.C. 7:26-3.2(f)2]  
Did applicant, permittee and/or licensee provide any assistance or information requested by the Department or the Attorney General, and cooperate in any inquiry or investigation conducted by the Attorney General or the State Commission of Investigation and any inquiry, investigation, or hearing conducted by the Department?  Note: If, upon issuance of a formal request to answer any inquiry or produce information, evidence or testimony, any applicant or licensee refuses to comply, the application of the business concern for a license may be denied, or the license of that business concern may be revoked by the Department. [N.J.A.C. 7:26-16.7(a)]  
Upon request, did the applicant supply physical evidence, including but not limited to photographs or handwriting exemplars of any individual listed on the disclosure statement or any amendments thereof?. [N.J.A.C. 7:26-16.7(b)]  
EQUIPMENT OWNERSHIP/LEASING REQUIREMENTS.  
Are all registered solid waste vehicles, owned or leased by the applicant?  If leased, was a copy of the lease, along with a copy of the Motor Vehicles Registration card, supplied when filing the registration statement?. [N.J.A.C. 7:26-3.2(h)]  
Is a copy of any lease filed in connection with the solid waste registration of a solid waste vehicle, carried in the solid waste cab and made available to Department representatives upon inspection or request?. [N.J.A.C. 7:26-3.4(h)1]  
Does the lease agreement contain required items, including: signatures; start/end dates;  payment methods; person responsible for vehicle maintenance and tipping fees; and vehicles VIN and tag numbers?. [N.J.A.C. 7:26-3.2(i)1-6]  
Does the lease agreement contain the required affidavit of responsible person, along with vehicle VIN and plate numbers?. [N.J.A.C. 7:26-3.2(i)71-2]  
Does the lease agreement contain required items?. [N.J.A.C. 7:26-3.2(i)73-4]  
Did the lease contain a provision that the leased equipment is and will be under the exclusive management, direction and control of the NJ DEP Registered Transporter?. [N.J.A.C. 7:26-3.2(j)]  
Did transporter remove and destroy decals/registration numbers from vehicles with expired leases and not use a leased SW vehicle in ways other than allowed for in the lease?. [N.J.A.C. 7:26-3.2(k)]  
Did operator remove and destroy all expired decals and registration numbers from all vehicles with expired leases, or give written notice of its inability to do so?. [N.J.A.C. 7:26-3.2(k)1]  
Note: All expired decals and registration numbers will be confiscated by the Department upon discovery. [N.J.A.C. 7:26-3.2(k)2]  
Did the permittee/licensee file required business concern disclosures for the lessor, and personal history disclosure statements for directors, officers, key employees, partners and equity holders of the lessor or, if the lessor is an applicant, provide within 10 days notice to the Division of Law,  A-901?. [N.J.A.C. 7:26-16.6(i)]  
Did the permittee/licensee who leases 20 or more SW vehicles file, or cause the lessor to file, a business concern disclosure statement and personal history disclosure statement?  If lessor is an applicant, did he file a written notice within 10 days to the A-901 Unit? . [N.J.A.C. 7:26-16.6(j)]  
REPORTING REQUIREMENTS.  
Does transporter who hauls solid waste directly to out-of-State facilities from districts which have not designated an in-county weighing facility pursuant to N.J.A.C. 7:26-6 maintain a daily record of waste transported directly out-of-State?  Is the daily record retained for a period of at least one year or longer in the event of a unresolved enforcement action or at the Department's request?  Does the daily record include the following information: 1. Identification of the transporter's DEP registration number and solid waste decal number; 2. Identification of the out-of-State disposal facility where the solid waste was disposed including the state in which the facility is located, the facility name and location address of the facility; 3. The cubic yardage or tonnage of solid waste types: ID 10 through ID 27, including any variants; 4. Date of delivery to the out-of-district facility; 5. The license plate number and State of the solid waste vehicle; and 6. The place of origin of the waste identified by municipality, county and state, except in those instances where the waste is transported from a transfer station or materials recovery facility to a final disposal facility.  In those instances, the facility ID of the transfer station or materials recovery facility shall be listed instead of the municipality, county and state as indicated above?. [N.J.A.C. 7:26-3.5(e)]  
Does transporter comply with the requirements concerning solid waste intermodal containers used to transport solid waste solely by rail, including:  American Assoc. of Railroads; numerical container marking;  container registration?. [N.J.A.C. 7:26-3.5(f)]  
Did transporter notify the Department at 1-877-WARNDEP within 24 hours of an incident involving smoking, smoldering or burning solid waste in any solid waste vehicle?. [N.J.A.C. 7:26-3.7(c)]  
VEHICULAR / OPERATIONAL REQUIREMENTS.  
Did operator not allow vehicles exempt under this section as solid waste vehicles to discharge solid waste at or near areas where solid waste vehicles required to be registered in accordance with N.J.A.C. 7:26-3 are unloading or where heavy equipment is operating?. [N.J.A.C. 7:26-3.3(c)]  
Are SW service routes/equipment designed so the routes can be completed during a normal operating day?. [N.J.A.C. 7:26-3.4(a)]  
Did operator dispose of SW at only an approved facility? Were recyclables deposited only at a facility approved to accept those types of recyclables and commingled only to the extent permitted in the facility approval?. [N.J.A.C. 7:26-3.4(b)]  
Did transporter ensure solid waste was not allowed to remain or be stored in any solid waste transport units in excess of 24 hours?. [N.J.A.C. 7:26-3.4(c)]  
Does the operator only use vehicles designed to not allow solid waste material to leak or cause emissions there from?. [N.J.A.C. 7:26-3.4(d)]  
Is the solid waste vehicle not loaded beyond its design capacity or in such a manner that littering, leakage, spillage or emissions there from of solid wastes will occur?. [N.J.A.C. 7:26-3.4(e)]  
Did operator maintain solid waste vehicle in good, safe, working order, and provide continuous service in emergencies?. [N.J.A.C. 7:26-3.4(f)]  
Do all workers and collection crews operating SW transportation systems take reasonable care to protect the property of customers? . [N.J.A.C. 7:26-3.4(g)]  
Did transporter conspicuously display on each solid waste vehicle a current solid waste decal and the (N.J.D.E.P.) registration number and the name of the registered company; and have a copy of any lease filed in connection with the solid waste registration of a solid waste vehicle in the solid waste cab and  available to Department representatives upon inspection or request?. [N.J.A.C. 7:26-3.4(h)]  
Did transporter only display current period decals, and remove all decals and registration numbers from vehicles that are sold or have expired leases?. [N.J.A.C. 7:26-3.4(h)2]  
Did the transporter affix to the driver?s side of each registered solid waste vehicle, in letters and numbers at least three inches in height, the capacity of the solid waste transport unit in cubic yards, in tons or in gallons, so as to be visible to the operator of the solid waste facility?. [N.J.A.C. 7:26-3.4(h)3]  
Did transporter use tarpaulins or covers while transporting solid waste?. [N.J.A.C. 7:26-3.4(i)]  
Do all SW vehicles access and exit facilities as per county plan or the SWF permit?. [N.J.A.C. 7:26-3.4(j)]  
Do SW transporters haul SW in accordance the district SW Management Plan? In a district which has a weighing facility, does transporter weigh all SW prior to out-of-district transfer, materials recovery, or disposal?. [N.J.A.C. 7:26-3.4(m)]  
Are bulky waste vehicles designed so as to preclude spillage or leakage or emissions in violation of N.J.A.C. 7:27 therefrom. [N.J.A.C. 7:26-3.5(b)]  
Does the facility operator retain all O and D forms for a minimum of one year and make them available for inspection by representatives of the Department, county lead agency certified by the Department pursuant to N.J.S.A. 26:3A2-1 et seq., county from which solid waste is received, and the local health department at any time during normal working hours?. [N.J.A.C. 7:26-2.13(c)2]  
Did transporter ensure that no smoking, smoldering or burning waste is transported?. [N.J.A.C. 7:26-3.7(a)]  
Did transporter who dumped a hot load in an emergency immediately notify the local police/fire departments, and clean up all dumped material?. [N.J.A.C. 7:26-3.7(b)]  
Did the operator comply with all of the rules and regulations of NJDMV? . [N.J.A.C. 7:26-3.2(a)6]  
Did transporter comply with any conditions or limitations specified on the approved registration?. [N.J.A.C. 7:26-3.2(c)]  
Did transporter ensure that radioactive material and lethal chemicals are not transported in or through this State without prior written approval from authorities having jurisdiction and from the Department?. [N.J.A.C. 7:26-3.5(c)]  
SPECIFIC REQUIREMENTS CONCERNING SEWAGE SLUDGE AND OTHER FECAL MATERIAL.  
Are sewage sludge vehicles designed so as prevent spillage or leakage or emissions in violation of N.J.A.C. 7:27 therefrom?. [N.J.A.C. 7:26-3.5(a)1]  
Does transporter not intermix sewage sludge and other fecal material with other wastes of a chemical or industrial nature for transportation to a disposal operation?. [N.J.A.C. 7:26-3.5(a)2]  
SPECIFIC REQUIREMENTS CONCERNING ASBESTOS CONTAINING WASTE.  
Are asbestos carrying vehicles designed so as to prevent any spillage or leakage or emissions therefrom. [N.J.A.C. 7:26-3.5(d)1]  
Did transporter ensure asbestos and/or asbestos-containing waste materials were properly packaged in accordance with 40 C.F.R. 61.150 and N.J.A.C. 7:26-2.12?. [N.J.A.C. 7:26-3.5(d)2]  
Did transporter transport asbestos or asbestos-containing waste materials in a manner that prevents the rupture of the asbestos containers in loading, transport, and unloading operations?. [N.J.A.C. 7:26-3.5(d)3]  
Did transporter of asbestos and/or asbestos containing waste materials transport them directly from the point of generation to the solid waste landfill or transfer station permitted to receive such wastes?. [N.J.A.C. 7:26-3.5(d)4]  
Did transporter ensure there were no visible air emissions during loading, transporting, or unloading operations?. [N.J.A.C. 7:26-3.5(d)5]  
Did landfill owner and/or operator ensure that no person enters an asbestos disposal area at a landfill during the unloading and covering of asbestos and asbestos-containing waste materials without wearing a respirator approved for asbestos by the National Institute for Occupational Safety and Health and the Mine Safety and Health Administration?  This equipment shall be provided and maintained in good working order by the landfill owner and/or operator for its employees. [N.J.A.C. 7:26-2A.8(l)2vi]
