Exempt Recycling Center - Other Class B Mat'ls - Gen. Reqt's (SW55) - Short Version

Is the facility operating in a manner consistent with the protection of public health, safety and the environment?. [N.J.A.C. 7:26A-1.4(b)1]  
Note: Activities exempted pursuant to this section which exceed or violate the criteria for exemptions specified in N.J.A.C. 7:26A-1.4(a) and of this subsection, or which are conducted in a manner which endangers the public health, welfare and safety or the environment, or which are in violation of Federal, State or local law, shall be subject to regulation as a recycling center pursuant to this chapter or subject to the solid waste rules pursuant to N.J.A.C. 7:26. [N.J.A.C. 7:26A-1.4(b)3]  
Is the facility submitting required tonnage reports in accordance with N.J.A.C. 7:26A-4.4?. [N.J.A.C. 7:26A-1.4(b)4]  
Did facility operating pursuant to an exemption in N.J.A.C. 7:26A-1.4(a) provide a written notice of such operation to the New Jersey Department of Environmental Protection, Division of Solid and Hazardous Waste, Bureau of Recycling and Planning, P.O. Box 414, Trenton, New Jersey 08626-0414, the host municipality, and host county prior to the commencement of operations?. [N.J.A.C. 7:26A-1.4(b)5]  
Note: Exemption from the requirement of a general or limited approval pursuant to NJAC 7:26A-1.4 (a) shall not constitute an exemption from applicable county or municipal laws or regulations. [N.J.A.C. 7:26A-1.4(b)6]  
EXEMPT RECYCLING CENTER - OTHER CLASS B MATERIALS - GENERAL REQUIREMENTS.  
Is the facility operating as an exempt Class B recycling center without a general or limited approval while receiving scrap tires, leaves, non-container plastic materials and petroleum contaminated soil for temporary storage; or operating beyond the specified 60-day period in the notification letter; or temporarily storing materials more than twice a year or in succession; or operating on a continuous basis with materials stored in other than roll-off containers or other similar containers?. [N.J.A.C. 7:26A-1.4(a)7]  
Are materials stored in a manner which prevents runoff, leakage or seepage on or around the soil? Is there any prohibited processing or separation of the Class B material?  Does the facility have required documentation stating that the materials are transferred to an approved Class B facility?   Does the facility have required daily records showing amounts of material received and transferred; including the name of the disposal site?. [N.J.A.C. 7:26A-1.4(a)7iii]
